EVSTAR is committed to protecting your privacy. This Privacy Policy explains how EVSTAR (“we” “us” “our”) collect, use, and share information when you visit EVSTAR.com, Account.EVSTAR.com, and any related subdomains (the “Sites”).  This Privacy Policy also covers how we collect, use and share information collected as part of our EV charging station warranty services (the “Services”).

This Privacy Policy further describes your choices and rights regarding the use, access to and correction or deletion of your information. By using the Site, you acknowledge that you understand that we will use your information in accordance with this Privacy Policy. Where required by law, you will also be asked to provide affirmative consent to the collection, processing, and sharing of your user information via cookies and similar technologies.

Information You Provide

On EVSTAR.com:

  • Contact information (including first name, last name, email address, and phone number) collected via inquiry forms that are present on our Site(s).
  • Email addresses for subscribers of our digital newsletter subscription.

On Account.EVSTAR.com:

  • Account registration: First name, last name, business name, email address, phone number, and street address.
  • Product information: Charging station details, model numbers, and relevant purchasing information
  • Warranty claims: Issue descriptions, service requests, and related documentation to servicing warranty claims.
  • Payment information (processed by Stripe).  EVSTAR does not store credit card or related financial information.

Information Collected Automatically

When you visit our Sites, we automatically collect:

  • Device information (including IP address, browser type, device type, operating system)
  • Usage data (pages viewed, links clicked, time on site)
  • Cookies and tracking data (see Section 3)

Information Collected From Third Parties

We also gather information about you from other sources, including:

  • Public Sources, including information from public records, including state and municipal records to ensure compliance and enable regular business transactions.
  • Social Media Networks;
  • Other Third-Party Sources, including corporate customers we partner with and other partners we engage to help us prevent fraud, develop and enhance products, and support our marketing and promotion activities.
  • During on site visits.  EVSTAR may collect information directly from you during warranty related services.  This may also include ancillary information about you including anything visible to visitors, which may include personal information.
  1. How We Use Your Information

To Provide Our Services:  EVSTAR will use the information collected either directly from you, or collected automatically, or through third parties as identified in Section 1, to provide our warranty related services to you.  This includes processing warranty coverage and claims, managing your account, providing customer support, and processing payments.

Communicating with you:  EVSTAR will send transactional emails that include account updates and claim status reviews.  In addition to these two-way communications, EVSTAR will also:

  • Deliver newsletters, if you subscribed
  • Provide product updates and promotional offers which you can opt out of.

Improve Our Business:  EVSTAR will analyze website usage and user behavior in order to improve site functionality, measure marketing effectiveness.  Information collected by EVSTAR may also be used to prevent fraud, and other security purposes.

Legal Compliance:  EVSTAR will collect, maintain, and as required share information it collects from you in order to comply with its own legal obligations, enforce our terms and policies, and protect and enforce our legal rights.

Data Processing:  Some of the activities described above could involve the use of AI tools or services to process your personal information. These AI tools and services could be developed by EVSTAR’s vendors, or developed by EVSTAR itself.

We share information with:

Affiliates:  EVSTAR will share information with Affiliates and other related parties who are under common Control.  “Affiliate(s)” means with respect to a party, any individual or entity that Controls, is Controlled by, or is under common supervision, where “Control” means either the common ownership of at least 50% of the voting interests of such entity or the power to direct the management or affairs of such entity.

Service Providers:  EVSTAR will share information with several categories of service providers in order to support its day-to-day activities.  Examples of such service providers include, analytics providers (like Google Analytics), advertising platforms (including Google Ads and Meta/Facebook), tag management services, and email service providers.  In addition to the foregoing, EVSTAR leverages several third-party service providers to perform data sharing and hosting objectives, such as cloud hosting, CRM platforms, and payment processing (like Stripe).

Legal Requirements:    EVSTAR will collect, maintain, and as required share information it collects from you in order to comply with its own legal obligations, enforce our terms and policies, and protect and enforce our legal rights. EVSTAR may further share information in order to comply with applicable legal or regulatory obligations, including as part of a judicial proceeding; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, whether formal or informal, from law enforcement or a governmental authority.  Further information may be shared, as required by law, or in connection with business transactions such as mergers or acquisitions.

  1. Data Retention

We keep your personal information for the retention periods laid out below, unless we are required to retain it for a longer period for a legal compliance purpose. 

  • Account data: We keep relevant account information, such as first name, last name, and street address, while warranty is active, plus an additional 7 years after the expiration date.
  • Claims data: We keep all information collected during the course of any claim or filing, for 7 years following the closure of the corresponding claim
  • Marketing data: Until you unsubscribe or send us a request to delete your information.
  1. Your Rights and Choices in Connection with Personal Information

Many U.S. State privacy laws grant you a number of rights (subject to certain exceptions) with respect to personal information that companies may hold about you. Each of your rights is outlined in more detail below:

  • Right to Know & Right to Access. You have the right to request that we tell you:
    • the categories of personal information we collected, sold, or disclosed for a business purpose in the previous 12 months;
    • the categories of sources from which we collected such personal information;
    • the business or commercial purposes for collecting and selling such personal information; and
    • the categories of third parties to whom we sold or disclosed for a business
    • purpose such personal information and the specific categories of personal information sold or disclosed to each category of third party.
  • In addition, you have the right to request a copy of the specific pieces of personal information that we have collected from you in the 12 months preceding your request. If we are able to confirm your identity to the degree required by law and corresponding regulations, we will disclose to you a copy of the specific pieces of personal information about you that we have processed.
  • Right to Delete. You have the right to ask us to delete or remove the personal information we have collected from you and retained. Upon our confirmation of your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies (for example, where your information helps us comply with a legal obligation, or detect or prevent security incidents, or as required to comply with applicable law).

Marketing

  • Email Marketing Opt Out. You may opt-out of receiving promotional communications from us by following the opt-out instructions contained in our latest marketing e-mail communication to you. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving promotional emails about recommendations or other information we think may interest you, we may still send you e-mails about your account or any services you have requested or received from us.

We have a robust security program that uses appropriate technical, administrative, and physical controls to protect information against accidental or unlawful destruction, loss, disclosure, alteration or use. We also require similar security obligations of our vendors and business partners.  Prior to engaging any third-party service provider, EVSTAR performs due diligence to evaluate their privacy and security practices.

Individual users of Account.EVSTAR.com are encouraged to protect their personal information by using strong passwords and not sharing your account credentials.

Our Sites may link to third-party websites. We’re not responsible for their privacy practices. Please review their privacy policies before providing any information.

  1. Children’s Privacy

Neither our Sites nor our Services are intended for anyone under 18. We don’t knowingly collect information from children. If you believe a child has provided us with information, contact us immediately at info@evstar.com.  If we discover that anyone under 18 has provided us with personal data, we will delete such information.

We may update this Privacy Policy periodically. We’ll notify you of material changes by posting a notice on our Sites, updating the “Last Updated” date, and affirmatively emailing account holders for significant changes. 

Your continued use after changes constitutes acceptance of the updated policy.  We update this Privacy Policy periodically to comply with global laws and regulations and our changing business practices. You will find the date of the most recent update at the top of the current Privacy Policy. Please visit this site periodically to read the Privacy Policy. We will comply with applicable laws to the extent they require any additional means of alerting you to changes to the Privacy Policy.
